Inter-American Court condemns Colombia for the extermination of the UP party

BOGOTÁ (AP) — The Inter-American Court of Human Rights (IACHR) condemned the Colombian State on Monday for the "extermination" of the political party Unión Patriotica, in which more than 6,000 members were victims of acts of "systematic" violence such as disappearances , extrajudicial executions, threats, murders or torture from 1984 and for more than two decades.

"These acts constituted a form of systematic extermination against the UP political party, its members and militants, and had the participation of state agents, as well as the tolerance and acquiescence of the authorities," the Court indicated in the official summary of its judgment.

The Patriotic Union was established as a political organization in 1985 after a peace dialogue between the Colombian government and the Revolutionary Armed Forces of Colombia (FARC) that opened the door for them to legally engage in politics.

However, the Court adds, to counter the political rise of the Patriotic Union, an alliance arose between paramilitary groups, sectors of traditional politics, businessmen and the public force that led to acts of violence.

The FARC only laid down their weapons in 2016, after a peace agreement with the State that is still being implemented in Colombia.

The Court, based in the Costa Rican capital, concluded that the Colombian State violated the political rights, freedom of thought and expression of the members of the Patriotic Union because they were victims of human rights violations for belonging to said party and expressing his political ideas.

“This is the day of justice for the UP, because for the first time a court has ruled that the extermination was caused by the State. It is a very big step,” Senator Aída Avella of the Patriotic Union, who survived a bazooka attack in 1996 and lived in exile for 17 years, told The Associated Press.

Avella regretted that many of the relatives of those murdered and disappeared died before seeing the sentence, after 29 years of initiating the lawsuit before the Inter-American Commission on Human Rights. "There are children who did not resist the death of their parents," she said.

President Gustavo Petro —the first leftist in the history of Colombia— assured in a Twitter message that his government will support justice "against impunity" and rejected "a murderous State that should not return anymore, a society of privileges that murders rather than allow change.

In its judgment, the Court identified that, of the more than 6,000 direct victims of the UP, 3,170 corresponded to cases of extrajudicial executions, 1,596 to forced displacements, 521 to forced disappearances, and 285 to victims of attacks or attempted homicides. The Court detailed that at least seven girls and four boys were victims of extrajudicial executions or survived massacres against members of the Patriotic Union.

“The genocide in Colombia was supremely prepared, there was no stray bullet, they killed us and the State is to blame,” Avella said. “They put escorts on us, supposedly to protect us, but they kept track of where we lived, of our families. It was just that he thought differently so that he was an 'internal enemy' and they killed him, ”he added.

Despite the number of crimes and the fact that more than 265 convictions have been handed down in Colombian justice, the Court determined that the investigations were not effective and there are still "high rates of impunity" because most of the violence against the militants of the left party has not been investigated or the processes are in early stages.

Avella believes that the Colombian justice system has sufficient elements to advance the investigations that have been delayed for years. Previous prosecutors "had opened a special section for the UP and to our surprise we found that many of the files had disappeared in the Prosecutor's Office, we had to take them back," said the congresswoman.

Among the reparation measures for the victims, the Court ordered Colombia to initiate, reopen, continue and conclude "within a reasonable time" the investigations to determine criminal responsibilities. In addition, search for the victims of disappearances and establish a commission that is in charge of verifying the identity and relationship of the victims.

The State must also carry out a public act of recognition of international responsibility, establish a national day in commemoration of the victims of the UP and build a monument.

 

Corte IDH condena a Colombia por exterminio de partido UP

BOGOTÁ (AP) — La Corte Interamericana de Derechos Humanos (Corte IDH) condenó el lunes al Estado colombiano por el “exterminio” del partido político Unión Patriótica, en el que más de 6.000 integrantes fueron víctimas de actos de violencia “sistemática” como desapariciones, ejecuciones extrajudiciales, amenazas, asesinatos o torturas a partir de 1984 y por más de dos décadas.

“Esos actos constituyeron una forma de exterminio sistemático contra el partido político UP, sus miembros y militantes, y contaron con la participación de agentes estatales, así como con la tolerancia y aquiescencia de las autoridades”, indicó la Corte en el resumen oficial de su sentencia.

La Unión Patriótica se constituyó como organización política en 1985 tras un diálogo de paz entre el gobierno colombiano y las Fuerzas Armadas Revolucionarias de Colombia (FARC) que abrió la puerta para que pudieran hacer política legalmente.

Sin embargo, añade la Corte, para contrarrestar el ascenso político de la Unión Patriótica surgió una alianza entre grupos paramilitares, sectores de la política tradicional, empresarios y la fuerza pública que derivó en actos de violencia.

Las FARC sólo dejaron las armas en 2016, tras un acuerdo de paz con el Estado que aún se está implementando en Colombia.

La Corte, con sede en la capital costarricense, concluyó que el Estado colombiano violó los derechos políticos, la libertad de pensamiento y expresión de los integrantes de la Unión Patriótica debido a que fueron víctimas de violaciones de derechos humanos por pertenecer a dicho partido y expresar sus ideas políticas.

“Este es el día de la justicia para la UP, porque por primera vez un tribunal falla en el sentido en que el exterminio fue ocasionado por el Estado. Es un paso muy grande”, dijo a The Associated Press la senadora de la Unión Patriótica Aída Avella, quien sobrevivió a un atentado con una bazuca en 1996 y vivió en el exilio durante 17 años.

Avella lamentó que muchos de los familiares de los asesinados y desaparecidos murieron antes de ver la sentencia, luego de 29 años de iniciar la demanda ante la Comisión Interamericana de Derechos Humanos. “Hay hijos que no resistieron la muerte de sus padres”, aseguró.

El presidente Gustavo Petro —primero de tendencia izquierdista en la historia de Colombia— aseguró en un mensaje de Twitter que su gobierno apoyará la justicia “contra la impunidad” y rechazó “un Estado asesino que no debe retornar más, una sociedad de privilegios que asesina antes que permitir el cambio”.

En su sentencia, la Corte identificó que, de las más de 6.000 víctimas directas de la UP, 3.170 correspondieron a casos de ejecuciones extrajudiciales, 1.596 a desplazamientos forzados, 521 a desapariciones forzadas y 285 a víctimas de atentados o tentativas de homicidio. La Corte detalló que al menos siete niñas y cuatro niños fueron víctimas de ejecuciones extrajudiciales o sobrevivieron a masacres contra integrantes de la Unión Patriótica.

“El genocidio de Colombia fue supremamente preparado, no había bala perdida, nos mataban y el Estado es el culpable”, señaló Avella. “Nos pusieron escoltas, supuestamente para protegernos, pero nos hacían seguimiento de dónde vivíamos, de nuestras familias. Era solo que pensara distinto para que fuera ‘enemigo interno’ y lo mataban”, agregó.

Pese a la cantidad de delitos y a que se han pronunciado más de 265 sentencias de condena en la justicia colombiana, la Corte determinó que las investigaciones no fueron efectivas y aún hay “altos índices de impunidad” debido a que la mayor parte de la violencia contra los militantes del partido de izquierda no ha sido investigada o los procesos están en etapas tempranas.

Avella considera que la justicia colombiana tiene elementos suficientes para adelantar las investigaciones que por años fueron dilatadas. Anteriores fiscales “habían abierto una sección especial para la UP y con sorpresa encontramos que muchos de los expedientes habían desaparecido en la Fiscalía, tuvimos que volver a llevarlos”, relató la congresista.

Entre las medidas de reparación a las víctimas, la Corte ordenó a Colombia iniciar, reabrir, continuar y concluir “en un plazo razonable” las investigaciones para determinar las responsabilidades penales. Además, buscar a las víctimas de desapariciones y establecer una comisión que se encargue de contrastar la identidad y parentesco de las víctimas.

El Estado también deberá realizar un acto público de reconocimiento de responsabilidad internacional, establecer un día nacional en conmemoración de las víctimas de la UP y construir un monumento.
