Inter-American Court on Human Rights rules that Honduras must protect Garífuna communities and up its search to find the men who were disappeared

Therefore, the President of the Inter-American Court on Human Rights…

RESOLVES

1- to require that the State of Honduras adopt all necessary and adequate measures to determine the whereabouts of Milton Joel Martínez Álvarez, Suami Aparicio Mejía García, Gerardo Misael Trochez Calix y Albert Snaider Centeno Thomas, who have been disappeared since 18 July 2020…

2- to require the State of Honduras to adopt all appropriate measures to effectively protect the rights to life and personal integrity of the members of the Garífuna Communities of Triunfo de la Cruz and Punta Piedra that develop collectively actions in defense of the rights of the Garífuna people…

3- Representatives must report, no later than August 11, 2020, the identity of the inhabitants of these two communities that will be beneficiaries of these urgent measures…

4- The State must immediately coordinate with the beneficiaries of these measures, or their representatives, the planning and implementation of the same and that, in general, keep them informed about the progress of their execution.

5- to require the State to submit updated information to the Court on the protection measures that were adopted no later than August 24, 2020.

6. to require the State to continue to report to the Court every two months, counted from the submission of its last report, on the measures adopted.

7. To order that the Secretariat of the Court notify this Order to the State of Honduras, the Inter-American Commission and the representation of the beneficiaries.

RESOLUCIÓN DE LA PRESIDENTA DE LA CORTE INTERAMERICANA DE DERECHOS HUMANOS DE 6 DE AGOSTO DE 2020 ADOPCIÓN DE MEDIDAS URGENTES CASO COMUNIDADES GARÍFUNAS DE TRIUNFO DE LA CRUZ Y PUNTA PIEDRA VS. HONDURAS

POR TANTO:

LA PRESIDENTA DE LA CORTE INTERAMERICANA DE DERECHOS HUMANOS,

en uso de las atribuciones que le confieren los artículos 63.2 de la Convención Americana, y 24.1 y 25.2 del Estatuto de la Corte, y los artículos 4, 27, y 31.2 del Reglamento del Tribunal,

RESUELVE:

1. Requerir al Estado de Honduras que adopte todas las medidas necesarias y adecuadas para determinar el paradero de Milton Joel Martínez Álvarez, Suami Aparicio Mejía García, Gerardo Misael Trochez Calix y Albert Snaider Centeno Thomas que se encuentran desaparecidos desde el 18 de julio de 2020, de conformidad con los Considerandos 14 a 22 de la presente Resolución.

2. Requerir al Estado de Honduras que adopte todas las medidas adecuadas para proteger efectivamente los derechos a la vida, e integridad personal de lo integrantes de las Comunidades Garífuna de Triunfo de la Cruz y de Punta Piedra que desarrollan colectivamente acciones de defensa de los derechos del pueblo Garífuna, de conformidad con los Considerandos 23 a 27 de la presente Resolución.

3. Los representantes deberán informar, a más tardar el día 11 de agosto de 2020, la identidad de los pobladores de esas dos comunidades que serán beneficiarias de las presentes medidas urgentes para los efectos de lo dispuesto en el punto resolutivo 2.

4. El Estado deberá coordinar inmediatamente con los beneficiarios de estas medidas, o sus representantes, la planificación e implementación de las mismas y

que, en general, les mantenga informados sobre el avance de su ejecución.

5. Requerir al Estado que presente información actualizada a la Corte sobre las medidas de protección que fueron adoptadas a más tardar el 24 de agosto de 2020.

6. Requerir al Estado que continúe informando a la Corte cada dos meses, contados a partir de la remisión de su último informe, sobre las medidas adoptadas.

7. Disponer que la Secretaría de la Corte notifique la presente Resolución al Estado de Honduras, a la Comisión Interamericana y a la representación de los

beneficiarios.
